The Employee’s Benefits of Working on a Public Holiday
In Malaysia, working on a public holiday comes with some employee benefits. Governed by the Holidays Act and Employment Act, an employee is eligible to a two day off during the Chinese New Year. It only applies to those companies that have declared those two days as paid public holidays earlier. Incidentally, only five of the eleven gazetted paid public holiday cannot be negotiated or swapped.
Apart from these five, employers are compelled to select six of the remaining public, paid holidays from the listing. If a public holiday falls on a weekend (Saturday), the Employment Act entitles an employee to a double pay (hourly rates) or (triple pay if you happen to work overtime) or an alternative day as a replacement. If you work for five days in a week, you’ll not be eligible for any replacements or paid holiday wages should a public holiday fall on the weekend (Saturday).
